TRENCHBOT TERMS OF SERVICE

Introduction

Welcome to TrenchBot (“TB”), a non-custodial Discord-based cryptocurrency trading bot operated by FullPort LTD (“FP”, “we”, “us”, or “our”), a company registered in the British Virgin Islands (BVI).

By accessing or using TrenchBot, you agree to these Terms of Service (“Terms”). If you do not agree, you may not use TrenchBot.

1. Restricted Jurisdictions & Compliance

TrenchBot is NOT available to users in the following jurisdictions
  • The United States;
  • Any country subject to U.S., U.K., or E.U. sanctions, including but not limited to North Korea, Iran, Syria, Venezuela, and;
  • Any jurisdiction where crypto trading is prohibited or restricted.

Users are prohibited from bypassing restrictions using VPNs, proxies, or other anonymization techniques.

By using TrenchBot, you confirm that:

  • You are not a resident of a restricted jurisdiction.
  • You are not using a VPN, proxy, or any other tool to circumvent these restrictions.

2. Non-Custodial Nature & User Responsibilities

  • TrenchBot does not take custody of user funds.
  • Users create non-custodial wallets via Privy for each supported blockchain.
  • Users are responsible for securing their private keys. TB cannot assist with lost private keys.
If you lose your private key, you lose access to your funds. TB and FP are not responsible.

3. Trading & Transactions

3.1 How Trading Works

  • TrenchBot facilitates peer-to-peer (P2P) trading on supported blockchains.
  • Supported blockchains: Solana, Ronin (additional blockchains may be added).
  • Transactions occur directly on-chain through smart contracts.
TrenchBot does NOT process, control, or guarantee any transaction.

3.2 Deposits & Withdrawals

  • Deposits: Users fund their own non-custodial wallets before trading.
  • Withdrawals: Users withdraw funds from their wallets to external addresses.

All transactions are FINAL and irreversible. TB does not reverse, refund, or dispute transactions.

4. Fees & Referral Program

4.1 Trading Fees

  • A 1% trading fee applies per transaction.
  • Fees are deducted automatically from each trade.

4.2 Referral Rewards

  • Users can earn a share of trading fees from referrals.
  • Discord server owners integrating TrenchBot may receive a revenue share.
  • TrenchBot reserves the right to modify fees and referral terms at any time.

5. Third-Party Services & Disclaimers

TrenchBot integrates with third-party services, including but not limited to wallet providers, smart contracts, decentralized exchanges (DEXs), and blockchain networks. These third-party services operate independently and are not under the control of FullPort LTD.

  • FullPort LTD does not own, operate, monitor, or guarantee the security, availability, or performance of any third-party service integrated with TrenchBot.
  • While TrenchBot may be deployed within various Discord servers, including those operated by its Partners, it remains an independent trading tool operated solely by FullPort LTD.
  • FullPort LTD’s Partners assume no responsibility for TrenchBot’s functionality, transactions, security, or availability.
  • Users interact with third-party services at their own risk and should conduct their own due diligence before engaging in any transactions.

6. Deployment on Third-Party Servers:

  • TrenchBot is a software application that can be added to any Discord server by users with the appropriate permissions.
  • FullPort LTD does not verify, endorse, or control all servers where TrenchBot is deployed.

7. Liability Disclaimer:

  • FullPort LTD is not responsible for how TrenchBot is used, misused, or modified by third-party Discord server operators.
  • Users should always verify the legitimacy of any server before interacting with TrenchBot.
  • Users assume full risk when interacting with external services, wallets, or DEX integrations.

8. No Financial Advice & Risk Acknowledgment

Crypto trading is HIGH RISK. You trade at your own risk.
  • TrenchBot does NOT provide financial, investment, or legal advice.
  • Crypto markets are volatile, and you may lose all your funds.
  • TB is NOT responsible for price fluctuations, failed transactions, or lost assets.

9. Security & User Responsibility

  • Users must keep their private keys and wallet credentials secure.
  • TB and FP are not responsible for lost, stolen, or compromised credentials.
  • Do NOT share your private key with anyone.
  • TB will never ask for your private key. If someone asks, it’s a scam.
  • Fraudulent Impersonation & Phishing Warning:
    • Malicious actors may attempt to impersonate TrenchBot through fake links, phishing websites, or unauthorized Discord servers.
    • FullPort LTD and its Partners are not responsible for losses, damages, or security breaches caused by fraudulent versions of TrenchBot.

How to Protect Yourself:

  • Always verify the official TrenchBot link before using it.
    • Do NOT interact with TrenchBot in unknown or unverified Discord servers.
    • Never enter your private key or seed phrase anywhere—TrenchBot will never ask for it.

FullPort LTD and its Partners disclaim all liability for any losses due to impersonation scams, phishing attempts, or other fraudulent activity involving TrenchBot.

10. Limitation of Liability & Indemnification

Users agree to indemnify and hold harmless FullPort LTD and its Partners from any claims, damages, or losses related to their use of TrenchBot, including but not limited to:

  • Losses due to user mistakes, lost keys, smart contract bugs, or hacks.
  • Failures or downtime of blockchain networks or third-party services.
  • Regulatory changes affecting crypto transactions.
  • Unauthorized, fraudulent, or misleading use of TrenchBot, including but not limited to third-party Discord servers.

FullPort LTD’s Partners are not responsible for TrenchBot’s operations, functionality, or security. Users acknowledge that FullPort LTD’s Partners do not control TrenchBot and assume no liability for any issues arising from its use.

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the British Virgin Islands (BVI).
  • All disputes must be resolved through binding arbitration in the BVI, in accordance with the arbitration rules of a recognized arbitration institution, as determined by FullPort LTD.
  • Users waive the right to participate in class-action lawsuits against FullPort LTD or its Partners.

12. Force Majeure Clause

FullPort LTD is not liable for any failure or delay due to events beyond its control, including but not limited to:
  • Regulatory changes, cyberattacks, blockchain network failures, natural disasters, governmental actions, or acts of war, terrorism, or civil unrest.

13. Compliance with Discord & Platform Policies

  • Users must comply with Discord’s Terms of Service while using TrenchBot.
  • TrenchBot may restrict or ban access for violations of Discord’s policies.

14. Smart Contract & Code Risk Disclaimer

  • TrenchBot uses smart contracts for transactions.
  • FP is not responsible for bugs, vulnerabilities, or failures in smart contracts.
  • Users acknowledge the experimental nature of blockchain technology.

15. Regulatory Compliance & Tax Disclaimer

  • Users are solely responsible for compliance with all tax and regulatory obligations related to their crypto transactions, including any future changes to applicable laws.
  • FP does not provide tax reporting services—consult a professional for legal matters.

16. Transaction Delays & Blockchain Congestion

  • Network congestion can delay deposits, withdrawals, or trade execution.
  • FP is not responsible for losses due to blockchain delays.

17. Intellectual Property Protection

  • TrenchBot, its branding, software, and proprietary technology belong to FullPort LTD.
  • Unauthorized reproduction, distribution, or modification is prohibited.

18. Changes to These Terms

  • TB may update these Terms at any time.
  • Continued use of TB means you accept the latest version.
  • Major changes will be announced in the Discord community.
